Five towns west of Toledo, five zoning offices, five fees. All of them require a permit before a fence goes up. Here is what we could read, and where we had to stop.
Wauseon
Wauseon’s fence chapter, Chapter 1139, dates from 1990 and is still on the books. No fence may be built or altered without a permit from the Administrator. Residential heights, above finished grade:
- Ornamental fences: 3 feet in the front yard, 6 feet at the side and rear
- Chain link: rear and side yards only, 4 feet
- Privacy fences: rear and side yards only, 8 feet under Section 1139.04, but Section 1139.07 of the same chapter says no side or rear fence may exceed 6 feet
Two numbers for the same fence is a problem we cannot solve from our desk, so ask the city which it enforces before you buy. The rest is clearer: a 25 foot sight triangle at corners; 75 percent open within 10 feet of where a driveway meets the sidewalk; a solid fence within 2 feet of the property line only with a recorded easement agreement; no spikes or electric current; and you identify your own property lines.
The 2026 builders packet puts the residential zoning permit fee at $30, asks for a scaled site plan with distances to each property line, and says contractors must be registered. Apply at 230 Clinton Street, Wauseon OH 43567, on 419-335-5041.
Swanton
Swanton’s fence permit costs $20, and the fee doubles if you start before it is issued. Section 150.402, adopted in 2023, requires a zoning permit for every fence it allows. The heights:
- Front yard: 4 feet, and the fence must sit at least 40 feet back from the right-of-way in the R-1 and R-E districts, 25 feet in the others
- Corner lots: where your rear line meets another corner lot’s rear line, 10 feet from the side street right-of-way and 6 feet maximum
- Side and rear yards: fences enclosing a deck, patio or garden run 4 to 6 feet, with gates to match
A side or rear fence sits next to the lot line, not on it, unless it joins the neighbor’s existing fence with written agreement. Every yard needs one unlocked gate at least 3 feet wide. Barbed wire, electric fences, chicken wire, hog fencing and snow fence are prohibited. On a major or collector street the Planning Commission can allow an open ornamental front fence up to 6 feet.
The form wants a scaled plan and makes you solely responsible for your property lines. Pool fences must be 4 feet with self-latching, self-closing, lockable gates. The office is at 219 Chestnut Street, 419-826-9515; the village site listed a temporary office after a fire, so call first.
Napoleon
Napoleon is the simplest. Section 1127.08 allows fences, screening or walls up to 8 feet in the side and rear yards and 3 feet in the front yard, each with a permit. A fence may sit on the property line but not over it. At a street corner nothing over 3 feet may stand in the 25 foot sight triangle.
The residential application lists Fence/Pool/Deck at $25, and no work starts until the permit is issued. Zoning Department, 255 West Riverview Avenue, Napoleon OH 43545, (419) 592-4010, Monday to Friday 07:30 to 16:00.
Defiance
Defiance’s fee page lists fences at $40, paid in person by cash or check at the City Services Building, 631 Perry Street, Suite 101. The application, effective 1 January 2026, prints 6 feet maximum with a 3 foot line for the front. Call 419-784-2195 for a final inspection; the certificate expires after six months. The Zoning Commissioner is on 419-784-2249.
The June 2024 zoning code says a little more. In residential districts, ornamental see-through fences may be 4 feet facing a public street and fences may not exceed 6 feet in rear yards. On a corner lot nothing between 2.5 and 10 feet tall may stand within 20 feet of the corner. The finished side faces the neighbor, and a fence on the property line needs written consent from the abutting owners. The code gives no side yard number and its 4 foot front figure differs from the form’s 3 feet, so ask which applies. Starting without a permit doubles the fee; finishing without one triples it.
Bryan
Bryan requires a work permit to build, alter or replace a fence, and the fee is $20. The City Engineer’s page gives the residential limits as 3.5 feet in the front and corner side yards and 6 feet at the back and sides, with 8 feet in commercial and industrial side and rear yards. Fences may go up to the property line, and the smooth side faces out.
The code, rewritten in January 2024, reads differently: 48 inches in a front or corner side yard if the fence is at least half open, 36 inches if solid, and 6 feet at the interior side and rear. Two city sources, two front yard numbers; ask which the zoning administrator applies. Allow two weeks; a contractor must be on file with the income tax department first. Second floor of the Don North Municipal Building, 419-633-6010, 08:30 to 16:30 Monday to Friday.
Call 811 before anyone digs
Ohio law requires notice to the Ohio Utility Protection Service at least two working days before digging. Call 811 or 1-800-362-2764, or file online. A paid contractor has to make that call on every job. There is more on our 811 page.
What a fence costs here
Combined sales tax is 7.25 percent in Fulton, Henry and Williams counties and 6.75 percent in Defiance County. Under Ohio rules the fence contractor pays that tax on his materials and quotes you a lump sum, because a fence is an improvement to real property, so there is no tax line on your invoice.
See your price range
Put your fence runs into the estimator, see the installed range for your yard, then request a quote. Name your town when the installer calls: the same panels are a 3 foot decorative fence in a Napoleon front yard and a 6 foot privacy fence behind a Bryan house.
Questions people ask
Do all five towns need a permit for a fence?
Yes. Wauseon ($30 residential zoning permit), Swanton ($20), Napoleon ($25) and Defiance ($40) issue zoning permits, and Bryan issues a $20 work permit. Swanton doubles the fee and Defiance doubles or triples it if you start first.
How tall can a fence be in Wauseon?
Three feet in the front yard. At the side and rear the code gives two numbers: 6 feet for fences generally, and 8 feet for privacy fences in another section of the same chapter. Ask the city on 419-335-5041 which it enforces before you buy 8 foot panels. Chain link is 4 feet, rear and side only.
What are Swanton's fence rules?
Four feet in the front yard, set well back from the road, 40 feet in R-1 and R-E and 25 feet elsewhere. Side and rear fences around a deck, patio or garden run 4 to 6 feet, sit next to the lot line rather than on it, and every yard needs an unlocked gate at least 3 feet wide. The fee is $20.
How tall can a fence be in Napoleon?
Eight feet in the side and rear yards and 3 feet in the front yard, each with a $25 permit from the Zoning Department on (419) 592-4010. The fence may sit on the property line but not over it.
What does Defiance allow?
The fee is $40. The 2024 code allows ornamental see-through fences up to 4 feet facing a street and 6 feet in rear yards, while the 2026 application form prints 3 feet for the front and 6 feet as the maximum. The code does not give a side yard number. Ask the Zoning Commissioner on 419-784-2249 which applies to your lot.
What are the Bryan fence limits?
The City Engineer’s page says 3.5 feet in the front and corner side yards and 6 feet at the back and sides, for a $20 work permit. The 2024 code says 48 inches in front if the fence is at least half open, 36 inches if solid, and 6 feet at the interior side and rear. Ask which figure the city applies, on 419-633-6010.
